DUI/APC/DWI

When an individual under the influence of drugs or alcohol operates a moving vehicle, he/she can be charged with driving under the influence (DUI) or driving while impaired (DWI). The operator of the vehicle is held accountable regardless if the drugs taken were illegal or lawful medication.

Law enforcement officers have the right to charge individuals with APC, or actual physical control, if they feel the individual has the ability to turn on and operate the vehicle while still intoxicated, whether the individual was actually driving the car at the time or not. People are commonly charged with APC when they pull over to sleep in their car after a night of drinking.  The best way to avoid APC charges is to keep the keys out of reach, like in the trunk or outside the car. If the keys are not in the vehicle, there is a good chance you will not be charged or convicted with APC.

In order for a person to be charged with a DUI, DWI, or APC they must have a BAC over the legal limit. For a person over the age of 21, the legal blood alcohol content (BAC) is 0.08%. Drivers under the age of 21 are prohibited from operating a vehicle when their BAC is above 0.02% or higher. Any driver found in violation of the BAC legal limit will be subjected to DUI charges.

If law enforcement officials suspect that an individual is driving under the influence, they have the right to ask the driver to perform a variety of tests to determine sobriety. Typical test for DUI or DWI include a breath test, walking in a straight line, or a blood test. Typically, law enforcement looks for common signs of intoxication.  Slurred speech, alcohol on the breath, blood shot eyes, and open containers of alcohol will convince any law enforcement official that the driver is driving under the influence or driving while impaired.

DUI convictions are serious criminal offenses that are not taken lightly. An individual convicted of drunk driving may face severe punishments such as imprisonment, probation, loss or suspension of driver’s license, rehabilitation, heavy fines, or community service.
